Terms and Conditions
Welcome to 100K Company! These Terms and Conditions outline the rules and regulations for the use of our services in India and the UAE. By accessing our services, you agree to comply with these terms. If you disagree with any part of these terms, please do not use our services.
1. Definitions
Client: The individual or entity using the services provided by 100K Company.
Services: The digital marketing, website development, app development, WhatsApp and SMS marketing, influencer management, and other related services offered by 100K Company.
2. Services
100K Company provides a range of digital marketing and development services. The scope of work, deliverables, and timelines will be detailed in a separate agreement specific to each project.
3. Payment Terms
Invoices: Invoices will be issued as per the agreed milestones or schedule. Payments are due within 14 days of the invoice date unless otherwise specified.
Payment Default: In the event of payment default, 100K Company reserves the right to immediately terminate the contract and cease all services. Outstanding payments will be subject to lawful collection efforts.
Refund Policy: No refunds will be issued for services already rendered. In the event of contract termination due to payment default or delay in customer response, no refunds will be provided.
Payment Disputes: Any disputes regarding invoiced amounts must be raised within 7 days of the invoice date. After this period, the invoiced amount will be deemed accepted by the client.
4. Delay in Customer Response
Failure to respond to communications or requests for information from 100K Company for a period exceeding 14 days will result in the immediate cancellation of the contract, and no refund will be issued.
5. Use of Similar Creatives
100K Company reserves the right to use similar creatives for other projects to ensure efficiency and quality across our services.
6. Collaboration Rights
100K Company holds absolute rights to collaborate with any company or individual to complete the project without any notice to the client. This collaboration may involve sharing relevant project information as necessary to ensure project completion.
7. Client Leader Transfer
In the event of a transfer or removal of the client-side leader or negotiator, 100K Company must be notified at least 7 days in advance. Failure to provide this notification may result in the termination of the contract by 100K Company.
8 . Representation and Use of Projects
By engaging with our services, you agree that 100K Company may represent and use completed projects for promotional purposes. This includes, but is not limited to, showcasing projects on our website, social media platforms, and marketing materials.
9. Confidentiality
Both parties agree to keep confidential all information, data, and materials disclosed during the course of the project. This obligation extends beyond the termination of the contract.
10. Intellectual Property
Unless otherwise agreed in writing, all intellectual property rights for materials created by 100K Company during the course of the project remain with 100K Company until full payment has been received. Upon payment, the client will have a license to use the materials as agreed.
11. Data Security
100K Company implements industry-standard security measures to protect your personal information from unauthorized access, disclosure, alteration, or destruction. However, no method of transmission over the internet or electronic storage is 100% secure, and we cannot guarantee absolute security.
12. Limitation of Liability
100K Company will not be held liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of our services. Our liability will be limited to the amount paid for the services in question.
13. Government Actions Disclaimer
100K Company cannot be held responsible for any actions taken by government authorities that may result in the disclosure of your personal information. This includes but is not limited to requests for information made under applicable laws and regulations.
14. Indemnification
The client agrees to indemnify and hold 100K Company harmless from any claims, damages, liabilities, costs, or expenses (including legal fees) arising out of or in connection with the client’s use of our services, breach of these terms, or violation of any rights of a third party.
15. Termination
100K Company reserves the right to terminate the contract at any time, including midway, due to issues with the customer or external factors. In such cases, partial or full refunds may or may not be provided, depending on the circumstances. Additionally, any transfer of the client-side leader or negotiator must be communicated at least 7 days in advance, failure of which may result in contract termination.
16. Force Majeure
100K Company will not be liable for any failure or delay in performing its obligations due to circumstances beyond its reasonable control, including but not limited to acts of God, war, natural disasters, strikes, and power outages.
17. Changes to Terms and Conditions
100K Company reserves the right to update or modify these Terms and Conditions at any time without prior notice. Your continued use of our services after any changes to these terms will constitute your acceptance of such changes.
18. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of India and the UAE. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts in these jurisdictions.
